What We Do

When in the role of trial consultant, Ramsdell Consulting Services, LLC does not practice law but seeks to enhance the practice of law by facilitating the skills of the legal practitioner. Ramsdell Consulting Services, LLC will not provide expert testimony and will only perform consulting services under the direction and control of plaintiff’s legal counsel to protect attorney work product privilege.

Trial consultants are dedicated to providing the legal community with information on litigation related behavior and communication. They provide only those services and use only those techniques for which they are qualified by education, training, or experience. They maintain knowledge of relevant professional information related to the services they render.

Communicating and Presenting
Trucking Industry Safety Violations

Common areas of liability wherein Consultant can provide nationwide case specific communications assistance and presentation techniques and assistance include violations of the trucking industry safety rules, regulations, standards, practices and procedures, including any person or motor carrier or its employees who aided, abetted or encouraged the violation of any of them.

These violations may have included specific matters related to maintenance, brakes, air brakes, driver inspection reports and procedures, vehicle inspection required by motor carriers, wheel retention and deterioration, fatigued driving, texting, impaired driving, alcohol, drugs, brokers, shippers, night time crashes, vehicle lighting, conspicuity or speeding.

Violations also may have included the ineffective management of space and time, fleet and motor carrier safety management, planning schedules, loads and routes, hiring, firing, retention, supervision, training, required skills and required knowledge of commercial motor vehicle operators, commercial vehicle leasing agreements, pedestrian interaction, passenger management, commercial motor vehicle operator leasing agreements, violations of company safety manuals, company safety culture, the existence of and enforcement of company disciplinary procedures.

Violations also may have included operating a commercial motor vehicle during hazardous driving conditions, impaired commercial drivers, qualifications required of commercial motor vehicle operators, conditions that require the disqualification of commercial motor vehicle operators, the DOT medical examination requirements and certifications of commercial motor vehicle operators, equipment inspection, condition and use, inspection of cargo and cargo securement requirements, hazardous materials, EOBRD, business records that must be maintained by a motor carrier and for how long, and numerous other areas, including but not limited to violations of the commercial driver’s license (CDL) manual standards, practices and procedures, and including aiding and abetting violations of any of the multiple types of potential defendants.
